User Agreement

1. Nature of the Platform

Precious Sitters LLC ("the Platform") operates solely as a marketplace that connects families seeking childcare with independent childcare providers ("Sitters"). Precious Sitters LLC is not a childcare agency, employer of sitters, or direct service provider. All childcare services are provided independently by Sitters, not by Precious Sitters LLC.

2. Limitation of Liability

Precious Sitters LLC shall not be held liable for:

• Any injury, loss, or damage to persons or property arising from childcare services arranged through the platform.
• The conduct, actions, or omissions of any Sitter or Parent using the platform.
• The accuracy or completeness of any information provided by users.
• Service interruptions, technical failures, or platform downtime.
• Disputes between Parents and Sitters regarding payment, performance, or conduct.

By using this platform, you expressly agree that Precious Sitters LLC's total liability to you for any claims shall not exceed the amount of fees paid to the platform in the 30 days prior to the claim.

3. Parent Responsibilities

• Parents are solely responsible for evaluating the suitability of any Sitter they engage.
• Background check status displayed on profiles is provided for informational purposes only and does not constitute an endorsement by Precious Sitters LLC.
• Parents must ensure their home environment is safe for the Sitter.
• Parents are responsible for all payment obligations to Sitters as agreed.
• Precious Sitters LLC encourages families to request references from childcare providers when messaging through the platform during the booking process. References are provided directly by the sitter to the family.

4. Sitter Responsibilities

• Sitters must provide accurate, truthful information on their profiles.
• Sitters are independent contractors, not employees of Precious Sitters LLC.
• Sitters are responsible for their own taxes, insurance, and compliance with applicable laws.
• Sitters must maintain the confidentiality of any personal or household information shared by families.

5. Background Check Fees

Background check fees are paid directly by the user requesting or completing the background check (Parent or Sitter). Precious Sitters LLC does not absorb, reimburse, or subsidize these costs. Completion of a background check does not guarantee approval or placement on the platform.

6. Commission & Platform Fees

Precious Sitters LLC charges a commission on completed bookings facilitated through the platform. Current commission rates are disclosed at the time of booking. Premium profile fees and emergency booking fees are non-refundable once processed.

7. Cancellation Policy

Bookings may be cancelled at least 24 hours before the scheduled start time. Cancellations made within 24 hours of the booking may be subject to fees at the platform's discretion. Repeated cancellations may result in account restrictions or suspension.

8. Dispute Resolution

Any disputes between users and Precious Sitters LLC shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association in Chicago, Illinois.

9. Indemnification

You agree to indemnify, defend, and hold harmless Precious Sitters LLC, its officers, directors, and employees from any claims, liabilities, damages, or expenses arising from your use of the platform, your violation of this agreement, or your interaction with any other user.

10. Governing Law

This agreement is governed by the laws of the State of Illinois. Any legal proceedings shall be conducted in the courts of Cook County, Illinois.

11. Modifications

Precious Sitters LLC reserves the right to update this agreement at any time. Continued use of the platform following any changes constitutes your acceptance of the revised terms.
